Electoral Commission (EC)

The Electoral Commission claims that the full results of the December 7, 2020 presidential election were known to Mr. John Mahama and that the allegations in his petition are far-fetched.

His allegations have no legal basis and should be dismissed in their entirety, the electoral body said in its response to the petition filed by Mr John Mahama calling for a re-run of the presidential election.

He also posted a copy of FORM 13 at Commission Headquarters, as required by law.

The European Commission rejected paragraphs 31, 32, 33, 34 and 35 of the petition, submitted strict evidence of the petition to the petitioner and stated that the petitioner’s allegation was misleading and self-serving and did not meet the legal and factual requirements to establish the validity of the petition filed on the seventh day after the date of the petition. The December 2020 elections have taken place.

The first defendant denied all of the allegations contained in the motion to quash and stated that, despite all of the resources and training provided and the conditions created, minor discrepancies were possible due to errors in calculation and mathematics in comparing the results.
But this had no significant impact on the overall result, he said.

The first respondent stated that after the statement of 9. In December 2020, four constituencies in the Greater Accra Region reported updated results, with a net difference of 1,651 votes.

It says the update in the press release from the 10th. December 2020 was taken into account but had no significant impact on the announced overall results.

Further, the EC rejected paragraph 32 of the application and found that the sum of the said districts did not correspond to a difference of 5 662 as alleged by the applicant.

In rebuttal to the petitioner’s allegations, the first respondent stated that he followed all the processes and procedures required by law to conduct the December 7, 2020 presidential election, which must be conducted fairly for each candidate and without malice or bias against any person.

To increase transparency and public participation in the electoral process, it has published on its website all summary reports of the regional elections (Form 12).

A simple tabulation of this data will show that President Nana Akufo-Addo, the second respondent, actually won the election as announced, the EC said.

It indicates that the presidential election of the 7th. In December 2020, the Fourth Republican Constitution of 1992 and the Public Election Ordinance of 2020 (CI 127) will apply.
As explained before the presidential election, the EC has put in place a system to help ensure smooth and timely reconciliation.

He therefore announced that he would announce the results of the presidential election within 24 hours of the close of the polls.

The Commission also filed an interim appeal against the application, declaring it to be without jurisdiction and unconstitutional under Article 64(1) of the Constitution and Rule 68(1) of the Rules of the Supreme Court, 1996 (C.I. 16), as amended, which amounted to a challenge to the validity of the order of the First Respondent Committee on October 7, 1996. Presidential Election of December 2020.

Accordingly, she moved the Court of Appeals to summarily deny the motion and all supporting reasons for the lack of reasonable cause to appeal.
